1. Terms of Service
Welcome to QR RealEstate (“Service”), operated by QR RealEstate (“we,” “us,” or “our”). By accessing or using our website at qr-realestate.com or any related services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
1.1 Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements.
1.2 Account Registration
To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
1.3 Service Description
QR RealEstate provides tools for licensed real estate agents and brokerages to:
- Create and manage property listings
- Generate QR codes linked to branded lead-capture landing pages
- Capture, verify, and manage prospective buyer leads
- Send verification and marketing communications via email and SMS
- Import listings from MLS/IDX feed providers
- Export lead data for use in external CRM systems
1.4 Intellectual Property
All content, features, and functionality of the Service (excluding user-submitted content) are owned by QR RealEstate and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.
1.5 User Content
You retain ownership of any content you submit (listings, branding assets, messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and transmit that content solely to operate and provide the Service.
2. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law or regulation, including CAN-SPAM, TCPA, GDPR, or CCPA
- Send unsolicited bulk messages (spam) to leads or any third parties
- Upload fraudulent, misleading, or inaccurate listing information
- Harvest, scrape, or collect lead data for purposes unrelated to legitimate real estate transactions
- Impersonate another person, business, or brokerage
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to accounts, systems, or data
- Use the Service for any purpose other than legitimate real estate marketing and lead management
We reserve the right to suspend or terminate accounts that violate this policy without prior notice.
3. Privacy Policy
3.1 Information We Collect
We collect the following types of information:
- Agent account information: name, email address, password (hashed), brokerage details, branding assets (logo, colors, tagline), and contact preferences
- Lead information: name, email address, and/or phone number submitted by prospective buyers through listing landing pages
- Listing data: property addresses, prices, descriptions, photos, and MLS/IDX feed data
- Usage data: pages visited, QR codes scanned, and interactions with landing pages
3.2 How We Use Information
- To provide, maintain, and improve the Service
- To verify lead contact information via email or SMS codes
- To send transactional communications (verification codes, account notifications)
- To enable agents to send marketing follow-up emails to their verified leads
- To process payments and manage subscriptions
- To comply with legal obligations
3.3 Information Sharing
We do not sell, rent, or trade personal information. We share data only in these circumstances:
- With the listing agent: lead contact information is shared with the real estate agent who created the listing the lead interacted with
- Service providers: we use third-party services to operate the platform (SendGrid for email, Twilio for SMS, Vercel for hosting, Neon for database). These providers process data solely on our behalf under contractual obligations
- Legal requirements: when required by law, subpoena, or legal process
3.4 Data Retention
Lead data is retained for as long as the associated agent account is active. Agents may delete individual leads from their dashboard at any time. Upon account deletion, all associated data (listings, leads, branding) is permanently removed within 30 days.
3.5 Your Rights
Depending on your jurisdiction, you may have the right to access, correct, delete, or port your personal data. To exercise these rights, contact us at the address below. We will respond within 30 days.
3.6 Security
We implement industry-standard security measures including encrypted connections (HTTPS/TLS), hashed passwords (bcrypt), and secure server-side-only handling of API credentials. No system is 100% secure, and we cannot guarantee absolute security.
4. Data Processing & Lead Information
4.1 Agent Responsibilities
As a real estate agent using this Service, you act as a data controller for the leads you collect. You are responsible for:
- Using lead data only for legitimate real estate purposes related to the property listing the lead interacted with
- Complying with all applicable data protection and real estate regulations in your jurisdiction
- Responding to data access or deletion requests from your leads
- Not sharing lead data with unauthorized third parties
4.2 Lead Consent
By submitting their contact information through a listing landing page, leads consent to:
- Receiving a one-time verification code via email or SMS
- Having their verified contact information shared with the listing agent
- Receiving a one-time follow-up communication from the listing agent about the property they viewed
Leads may contact us or the listing agent to request deletion of their data at any time.
5. Email & SMS Communications
5.1 Transactional Messages
We send verification codes via email (SendGrid) and SMS (Twilio) as part of the lead verification process. These are transactional messages required to use the Service and are not marketing communications.
5.2 Marketing Emails
After verification, leads may receive a single follow-up email from the listing agent containing property details and agent contact information. Additional marketing emails are sent only when initiated by the agent through the dashboard. All marketing emails include an unsubscribe mechanism.
5.3 SMS Communications
SMS messages are sent only for verification codes and optional post-verification follow-ups. Standard messaging rates may apply. By providing a phone number, leads consent to receiving these messages. Leads can reply STOP to opt out of future SMS messages.
5.4 Agent Obligations
Agents using the dashboard email feature must comply with CAN-SPAM, TCPA, and all applicable regulations. Agents must not:
- Send deceptive or misleading messages
- Exceed reasonable sending frequency to their leads
- Continue contacting leads who have opted out or requested removal
6. Billing & Subscriptions
The Service offers a free tier and paid subscription plans. Paid plans are billed monthly and renew automatically. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months.
We reserve the right to modify pricing with 30 days’ notice. Price changes will not affect your current billing period.
7. Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for the accuracy of listing data imported from third-party MLS/IDX feeds
- We are not liable for any actions taken by agents with respect to lead data collected through the Service
8. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
